Photographer Terms and Conditions (Commercial)
Introduction
These terms and conditions (“the Agreement”) govern the contractual relationship between THP Shop (“the Photographer”) and businesses or individuals engaging commercial photography services (“the Client”). By availing our services, the Client agrees to be bound by these terms.
Booking and Confirmation
A non-refundable deposit of [Specify Amount or Percentage] is required to confirm the commercial photography services.
The booking is considered provisional until the deposit is received, and the Photographer reserves the right to release the booking if payment is not made within [Specify Timeline, e.g., 14 days].
Payment
Full payment for commercial photography services is due [Specify Timeline, e.g., 14 days] before the scheduled shoot.
Payments can be made by [Specify Payment Methods, e.g., bank transfer, cheque, or credit card].
Cancellation and Rescheduling
The Client may cancel or reschedule the commercial photography services by providing written notice to the Photographer.
The deposit is non-refundable. For cancellations made [Specify Timeline, e.g., more than 14 days] before the scheduled shoot, [Specify Percentage]% of the total fee will be charged. Cancellations made within [Specify Timeline, e.g., 14 days] of the shoot will incur the full fee.
Copyright and Usage
The Photographer retains the copyright to all images captured during the commercial project.
The Client is granted a license to use the images for commercial purposes as agreed upon in writing.
Creative Direction
The Photographer and Client will collaborate on the creative direction of the commercial project.
The final artistic decisions lie with the Photographer, who will strive to fulfill the Client’s creative vision within reason.
Delivery of Images
The Photographer will provide a selection of edited images within [Specify Timeline, e.g., 21 days] after the shoot.
The Client will receive the images in a digital format through a secure online gallery or other agreed-upon means.
Additional Usage and Licensing
Any additional usage beyond the initially agreed scope must be negotiated and may incur additional fees.
The Photographer and Client will mutually agree on any extended licensing or usage rights in writing.
Liability and Insurance
The Photographer is not liable for any loss or damage to property, injury, or any other unforeseen circumstances beyond their control.
The Photographer holds public liability insurance.
Governing Law and Jurisdiction
This Agreement is governed by the laws of England and Wales.
Any disputes arising out of or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
By availing our commercial photography services, the Client acknowledges that they have read, understood, and agreed to abide by these terms and conditions.
